2. Intellectual Property Rights

Our Intellectual Property

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”).

Our Content and Marks are protected by copyright and trademark laws, as well as various other intellectual property rights, unfair competition laws, and treaties around the world. The Content and Marks are provided in or through the Services “AS IS” for your personal, non-commercial use or internal business purposes only.

Subject to your compliance with these Legal Terms, including the Prohibited Activities section below, we grant you a non-exclusive, non-transferable, revocable licence to access the Services, and download or print a copy of any portion of the Content to which you have properly gained access, solely for your personal, non-commercial use or internal business purpose.

3. User Representations

By using the Services, you represent and warrant that:

• All registration information you submit will be true, accurate, current, and complete;
• You will maintain the accuracy of such information and promptly update it as necessary;
• You have the legal capacity and you agree to comply with these Legal Terms;
• You are over the age of 18 years old. Persons under 18 are not permitted to use or register for the Services;
• You will not access the Services through automated or non-human means, whether through a bot, script, or otherwise;
• You will not use the Services for any illegal or unauthorised purpose;
• Your use of the Services will not violate any applicable law or regulation.

4. User Registration

You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

Due Diligence Warning: Joblinker does not independently verify the identity, qualifications, or licences of users. We do not represent or warrant that any profile, name, photograph, review, or user-submitted content is accurate or truthful. Users engage with each other at their own risk and must exercise due diligence before accepting or providing any service.

5. Purchases and Payment

We accept Visa, Mastercard, and American Express payments processed securely via our payment processor, Stripe.

You agree to provide current, complete, and accurate purchase and account information for all transactions. You agree to pay all charges at the prices in effect at the time of your transaction, including any applicable:

Referrer Reward Allocation

Where a Job Doer joined the Joblinker platform through a referral invitation link provided by another user (the Referrer), Joblinker may allocate a portion of the Platform Fee to that Referrer:

• 11% of the Transaction Amount is retained by Joblinker as the platform fee; and
• 4% of the Transaction Amount is paid to the Referrer as a referral reward.

The Referrer fee is paid directly from the Platform Fee and does not increase the total Transaction Amount charged to the Poster.

6. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user, you agree not to:

• Systematically retrieve data to compile directories or databases without written consent.
• Circumvent, disable, or interfere with security-related features of the Services.
• Bypass Platform Fees: Solicit or accept payments or jobs outside the platform, or encourage others to bypass the Joblinker payment protection system in any way.
• Share, solicit, or collect phone numbers, email addresses, or payment details (like Cash, PayID, bank transfers) in the chat workspace before an offer is booked.
• Impersonate another person or falsely represent your identity, qualifications, or licensing.

7. Contribution Licence

By posting your Contributions (including text, photos, files, and voice notes) to any part of the Services, you automatically grant Joblinker a non-exclusive, royalty-free, worldwide, perpetual, and sublicensable licence to host, store, reformat, and display your Contributions solely to facilitate the delivery of Services.

We do not claim ownership of your Contributions. You retain full ownership of all intellectual property rights associated with your uploads. You acknowledge that you are solely responsible for the legality and accuracy of your contributions.

8. Guidelines for Reviews

We may allow users to post reviews or ratings. When posting a review, you agree that you had a genuine and direct interaction with the user, that reviews do not contain offensive or defamatory language, and that you are not affiliated with a competitor to post biased feedback.

9. Governing Law

These Legal Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. You and JOBLINKER PTY LTD irrevocably submit to the exclusive jurisdiction of the courts of New South Wales, Australia, for the resolution of any dispute.

10. Payment Protection and Release Mechanism

Payments for Jobs are collected and held securely by Stripe under our Payment Protection system. When a Job Poster accepts an offer, the full agreed amount (inclusive of the Job Doer's quote, GST, and Stripe processing fee) is charged to the Poster's payment method and held securely until the job is completed.

Payment Release Flow:

• Once the job is done, the Job Doer must mark the Job as complete inside the platform.
• The Job Poster has three (3) business days to confirm that the Job has been completed satisfactorily or raise a dispute.
• If the Poster does not respond within this 3-day window, Joblinker reserves the right to automatically release the protected funds to the engaged Job Doer (less platform and Stripe processing fees).
• If a dispute is raised within the 3-day window, the funds remain securely held pending informal negotiation, in-app dispute support, or binding arbitration.

11. Australian Consumer Law Guarantee

Stripe card processing fees are non-refundable under all ordinary circumstances. Refund decisions for protected balances and platform fees are assessed case-by-case at the sole discretion of Joblinker corporate.
